What these cover
These terms are between you and Scapely LLC ("Scapely", "we"). They cover this website and the Scapely platform: Scapely Studio, Scapely Sales, Scapely Build and Scapely's Edge. If you sign a separate written agreement with us, that agreement wins where the two differ.
Accounts
- Scapely is for businesses. The person who signs up must be allowed to act for the company.
- Keep your account details accurate and your logins private. You are responsible for what your team does inside your account.
- Tell us right away if you think a login has been stolen.
Your data and data separation
Everything you enter is yours: pools, prices, quotes, contracts, customers. You give us permission to store and process it only to run the service for you. You can export it at any time.
Scapely LLC is a separate company from Duplessis Pools. Your data is private, including from Duplessis personnel. Nobody at Scapely accesses your data without a support grant from you, and every access is logged where you can see it. Our Privacy Policy describes the grant, the break-glass exception, and our security measures.
Fees and billing
- Plans are billed monthly in advance. Each plan includes 50 pools per year; pools above 50 are billed once a year at the per-pool rate on your plan.
- A one-time onboarding fee applies to new accounts, as listed on the pricing page or your order.
- Fees are charged by card through Stripe. You are responsible for any taxes that apply.
- We may change prices with 30 days' notice. A founding rate stays locked for as long as the founding terms you accepted say so.
Account status
Every account is in one of four states. Each change is logged with who made it, why and when, and we notify you by email.
- Active. Everything works.
- Past due. A payment failed. We retry the card and remind you. You keep full access during the grace period.
- Suspended. Your account is locked or read-only. Your data is kept. Paying what is owed, or fixing the issue, restores the account.
- Terminated. You have 30 days to export your data. After that window we delete it on a schedule.
We may suspend or terminate an account for non-payment, for breaking these terms, or for abuse such as login attacks, mass emailing, phishing, fraud or repeated chargebacks.
Homeowner payments
Payments from your customers go through Stripe Connect under your own Stripe account. Stripe is the regulated party for fraud checks and money-laundering rules on those payments. Scapely does not monitor your sales or finances. We do watch account behavior (login abuse, mass emailing, payment failures, chargebacks) to keep the platform safe.
AI features
AI features produce drafts: takeoffs, purchase orders, bill checks, replies. You review every draft before you send it or sign it. You are responsible for what you send and sign. The Privacy Policy explains what the AI provider receives.
What Scapely does not do
Scapely is a design, pricing and contracting platform. It does not detect utilities, obstructions, setbacks, easements, property lines, HOA limits, soil, drainage or code compliance. Site validation is the responsibility of the licensed builder.
Acceptable use
Do not use Scapely to break the law, to send spam or phishing, to attack other accounts or our systems, to scrape the service, or to resell access without a written agreement. Do not upload content you have no right to use.
Service and support
We work to keep Scapely available around the clock and we announce planned maintenance ahead of time. Unless a written agreement says otherwise, we do not promise a specific uptime. Support is available on business days through the app and at support@scapely.com.
Ownership
Scapely owns the software, its design and its name. You own your data and your brand. Feedback you give us may be used to improve the product without owing you anything for it.
Warranties and liability
Scapely is provided as it is. To the extent the law allows, we do not promise that it will be error-free or fit for a particular purpose. Our total liability to you for any claim is limited to the fees you paid us in the 12 months before the claim. We are not liable for lost profits or indirect damages. Nothing here limits liability that cannot be limited by law.
Ending the agreement
You can cancel at any time; the cancellation takes effect at the end of the current billing period, and the export window in Account status applies. We can end the agreement as described under Account status.
Governing law
These terms are governed by the laws of the State of Louisiana, USA. Disputes are handled in the courts of Louisiana.
